FINRA Arbitration

At Kirby McInerney, we believe in seeking redress for our clients through every means available to us.  While most of our securities practice involves federal court litigation, sometimes institutions and high net worth individuals that have lost money due to fraud are better served by pursuing redress for such wrongdoing through Arbitration.  In fraud related to the securities markets, depending upon the facts of the particular claim, we may advise that proceeding in a Financial Industry Regulatory Authority (FINRA) arbitration as the best course of action.  We have the skills to handle arbitration in other forums as well.

Arbitration proceedings have the advantage of being entirely confidential during the pendency of the claim.  Additionally, we typically can bring arbitration claims to conclusion much more quickly than court litigation and usually without the same kind of discovery burdens associated with court litigation.  Other reasons that are unique to the particular claims involved also may weigh in favor of arbitration.

At Kirby McInerney, we have used arbitration to successfully represent governmental and municipal entities, hospitals, universities and state finance authorities which have been damaged in complex commercial transactions with their broker-dealers and underwriters, and we have collected millions of dollars on their behalf.  When you retain our firm, you can be assured that we will recommend the best litigation vehicle for your claim, whether that is proceeding with the claim in court or in an Arbitration.
