KM Congratulates New Partners Juan Martinez, Sarah Flohr and Marko Radisavljevic

The firm is proud to announce new KM Partners Juan MartinezSarah Flohr and Marko Radisavljevic.  Please join us in congratulating Sarah, Marko, and Juan on this significant and well-deserved career achievement.

Juan Martinez represents state attorneys general and public entities in litigation and investigations, whistleblowers in federal and state false claim actions, and consumers in complex class action matters.  Prior to joining Kirby McInerney, Mr. Martinez practiced at a prominent national law firm in its Public Clients and Whistleblower practice groups. Previously, he worked for several multinational law firms, where he focused his practice on government investigations and enforcement actions as well as products liability litigation with an emphasis on pharmaceutical, medical device, and health care litigation. He has experience litigating a variety of complex matters in both state and federal courts, including multidistrict litigation.  Before attending law school, Mr. Martinez served in the United States Army and was also a member of the U.S. intelligence community.  Juan graduated from Florida State University (B.A.) and from Emory University School of Law (J.D.).

Sarah Flohr focuses her practice on antitrust, consumer fraud, and securities fraud litigation. Most recently, she acted as co-lead counsel in Dufoe v. DraftKings Inc., a class action alleging that DraftKings sold unregistered securities and ensured that money stayed on DraftKings’ private and exclusively controlled marketplace, propping up the market for an overall valuation of DraftKings’ NFTs and significantly harming investors, which resulted in a settlement of $10 million, and Doyle v. Reata Pharmaceuticals, a securities class action alleging that Reata made false statements concerning FDA guidance regarding the design of the clinical trial (CARDINAL) for Reata’s drug candidate, bardoxolone methyl, which resulted in a settlement of $45 million. She is based in the firm’s New York office, but – a native of the Midwest – she often represents the firm’s midwestern clients, acting out of our Chicago office.

Marko Radisavljevic focuses his practice on consumer fraud and antitrust matters. Most recently, he represented a certified class of Division I college coaches whose wages were illegally fixed at $0 in Ray et al. v. NCAA. The case has reached a settlement of $303 million, which has received preliminary approval. If granted final approval, the agreement will compensate approximately 7,718 college coaches who worked hard and provided valuable services to their teams without any pay or benefits.

Sarah and Marko both worked together on the representation of a class of consumers who were victims of gift card scams and from whom Apple allegedly withheld funds in Apple Gift Card Litigation. This matter resulted in a settlement of $35 million for the class.

Sarah graduated from Indiana University (B.A.) and from the University of Illinois Chicago School of Law (J.D.). Marko graduated from the University of San Diego (B.A.) and from California Western School of Law (J.D.).
