Partner Randall Fox Discusses New DOJ Whistleblower Incentive Program in Law360
Published in: Law360
NEW YORK -- KM Partner Randall Fox was quoted by Law360 on October 26 in an article discussing the Department of Justice’s new Fraud Whistleblower Incentive Program. The program offers payments of $10,000 to $30,000 for tips that lead to criminal fraud charges, allowing whistleblowers to receive awards before a case is resolved.
Mr. Fox raised concerns about the program’s structure and whether the DOJ has sufficient resources to evaluate and investigate an influx of submissions. “This is a program that has no particular parameters and no structure as to who's going to do the work,” he said.
He cautioned that a program with “essentially no barriers to entry” could encourage low-quality claims, potentially causing valuable submissions to be overlooked. His primary concern, he explained, is that the program might “sap resources that go into investigating serious claims of fraud.”
